The Foo Fighters’ Photo Contract Is Just as Bad as Taylor Swift’s…

photorelease

First Taylor Swift’s photo contract went viral, and now the Foo Fighters’ contract has.

Washington City Paper posted the band’s contract for freelance photographers. The contract gives the band editorial control and copyright to the photos, giving them “the right to exploit all or a part of the Photos in any and all media, now known or hereafter devised, throughout the universe, in perpetuity, in all configurations”.

Full size version of the contract here.

No, it is not ‘just as bad’ as the Taylor Swift contract, it is worse (from the point of view of the photographer), since it grants copyright in the photographs to the Foo Fighters, unlike the Swift contract, which gave Swift only limited rights to use the photographs for promotional purposes.

I wouldn’t describe this as bad. They just want any session work done for the to be on a “Work For Hire” basis. I totally understand that.

The Terms Of Use of Facebook, Google, Twitter e.t.c. are much worse.

Good luck getting your images out of Google Search…
