A federal judge has just denied a motion for summary judgment byMP3tunes in its battle against Capitol Records (EMI).   Which basically means, the expensive fight continues.  Perhaps more tellingly, court documents reveal that law firm Duane Morris LLP is ducking out of the MP3tunes fight, with founder Michael Robertson ordered to find new counsel by September 7th.  "MP3tunes filed for bankruptcy and was unable to pay them," Robertson flatly told Digital Music News.  "This is the outcome when a major international corporation spends $10 million on a legal assault over 5 years. No small company can withstand the onslaught."  

Mariah Carey has just been announced the latest judge of American Idol.  The pop superstar, and third best selling female artist of all time, is replacing Steven Tyler.  "It's the biggest recording artist that any of these (singing competition) shows have ever had," said Fox Entertainment president Kevin Reilly.

David Geffen, the famously media-shy business magnate, gave a rare interview at the Television Critics Association semiannual press tour on Sunday.  Among the topics of discussion were Inventing David Geffen, a PBS documentary about his rise to power, and the state of the music industry today.  Asked about the challenges and opportunities if he were entering the music industry today, Geffen simply said, "I’d kill myself".  Check out the full interview here.

Spotify just released some figures to commemorate its one-year anniversary.  American users have streamed over 13 billion songs and shared 27,834,742 songs, according to the company, with Facebook accounting for 55.3 percent of that pie.  Spotify also proclaimed their apps have been used for "23.7 million hours."  Still, they haven't given any direct info on payments made to artists... view Spotify's celebratory infogram.

Yes, that's vegan and animal rights activist Morrissey posing with a cat on his head (again) for a PETA campaign.  The message is that controlling animal birth rates can help prevent animal homelessness.  "Letting cats or dogs have litters is tantamount to shooting shelter animals in the head since it kills their chances of adoption.  Please do the right thing and spay or neuter your animals," said Morrissey.

AutoRap is currently the hottest iOS music app, with a quick move past Pandora and Spotify on the iTunes app charts.  Let's see how long the burst lasts, though Smule is known for some heavy-hitting entries.

And, Kobalt Music Group has just inked a long-term publishing administration deal with Paul McCartney, for territories outside North American and the UK & Ireland.
