British Parliament passed the Digital Economy Bill in April, but a pair of prominent ISPs are now seeking clarification on a number of aspects. And, for that matter, challenging potential inconsistencies with EU law. "Our dispute is not with the current government but with the previous administration which pushed this through without due process," said BT Retail Chief Executive Gavin Patterson. "We need clarity about whether this legislation is compatible with important EU laws."
The access providers are BT and TalkTalk, both of whom are demanding judicial review by the British High Court. And make no mistake, these providers have plenty to lose in this battle: the Act calls for ISPs to issue warning letters to infringing users, and potentially trigger disconnections in extreme cases.
That latter option is largely dependent on the success of the warning letters, though all of this is moving in the wrong direction for ISPs. So far, the current government has shown little interest in changing the law.

Just what are they smoking in Europe? ISP's will keep fighting, but even if they lose, snipping accounts is a death wish. Ineffective for one, a huge PR problem for another. Don't even get started on false-positives.
