The story on Zaptunes is getting "phishier" by the moment, especially as more stakeholders investigate. Initially viewed as a straight-ahead download scam, more information continues to point to some sort of phishing operation. Insiders at EMI Music continued to point to pending legal action, though details on this scam are still being collected as of Wednesday. Ostensibly, Zaptunes is offering the entire Beatles catalog for download, but the site has yet to actually deliver a song.
But, Zaptunes has been more than happy to collect a few credit cards and email addresses. Get it?
Or, something like that. The slipperiness continued on Wednesday, when Zaptunes told one rights owner that the site was merely a search engine for available downloads. "We understand your concern, however, we do not have a single MP3 file anywhere on our servers," the company emailed in response to a takedown demand. "Whenever a registered members looks for a song, we search for that song in our database, and if we find a website offering a legal download of that song, we display it to the user."

We understand your concern, however, we do not have a single MP3 file anywhere on our servers. We have a database of websites that offer free and legal music downloads. Whenever a registered members looks for a song, we search for that song in our database, and if we find a website offering a legal download of that song, we display it to the user. If we don't, then we look for that song on Amazon, iTunes and various other paid to download websites, and display the user their options. We are not providing any downloads directly or promoting piracy in any way.
Also, when a new member signs up, we make them agree to our terms and conditions, which clearly state that all the songs displayed on the website's home page or other parts are only for promotional purposes, and may not be available for either free or paid download.
If you still have any concerns about your clients music being listed on our website, we would be glad to take their names off.
