UK-based BitTorrent tracker OiNK was shuttered last year, though participants are now facing charges. That includes admin Alan Ellis, according to a posting on the now-lifeless OiNK.cd. "On 10 September 2008, Alan Ellis was charged with conspiracy to defraud," the site states. Additionally, a small number of music uploaders have also been charged, though reports differ on the exact number.
According to the site and police statements, Ellis is scheduled for a Magistrates Court hearing on September 24th, and a Crown Court hearing thereafter. The uploaders probably face a similar fate. Ellis was charged with conspiracy to defraud, and the uploaders face criminal copyright charges. OiNK, an invite-only repository of rare and pre-release music torrents, was shuttered by British and Dutch authorities in coordination with the IFPI and BPI in October of 2007.
The charges closely follow a prison sentence for an administrator of EliteTorrents, a tracker responsible for a high volume of pre-release movies. That is part of a heavier enforcement hammer for torrent tracking communities and pre-release content sites, on both sides of the Atlantic. EliteTorrents was shut down in 2005.
