Judge May Ask DOJ to Weigh In on Pandora-ASCAP Case

The ongoing Pandora vs. ASCAP batttle may be growing more complicated, with Judge Denise Cote potentially asking the US Department of Justice for input.  Law360 reports that Cote may need the DOJ opinion, partly to determine whether ASCAP members are allowed to craft ‘carve out,’ special direct deals with Pandora.

This case will bring about monumental changes if Cote rules in favor of Pandora, who believes that under DOJ decree, ASCAP has no right to discriminate between different forms of media in terms of licensing fees.

Although Cote has the ultimate say in the outcome of this trial, a DOJ weigh-in may significantly influence her decision.
