Britney Spears has officially filed a petition to have her father removed from her 12-year conservatorship.
Documents filed last week in a Los Angeles court reveal that the pop singer requests her father’s resignation. As a replacement, Spears seeks to appoint Jodi Montgomery, a state-appointed conservator who has acted on her behalf. Montgomery had served as her personal conservator for health issues since 2019, when her father relinquished that right.
Britney Spears’ controversial conservatorship and her father’s involvement have attracted attention from Congress. Some lawmakers are calling for these laws to be scrutinized to avoid situations where people can become trapped. Spears’ conservatorship has dragged on for twelve years. In the latest filing, Spears also reserved the right to petition for her conservatorship’s permanent termination under the state Probate Code.
Spears’ lawyer says she seeks to ensure that Montgomery has the power to make medical decisions, communicate with her doctors, and access her medical records. Montgomery could also limit visitors that Spears’ can receive and retain her security guards. The petition is not clear whether Jamie Spears will retain his role as conservator over her finances.
Jamie Spears’ lawyers have argued that Spears has ‘greatly improved’ his daughter’s financial estate. Britney Spears is now worth an estimated $60 million and her father is seeking to retain his control. His co-conservator, Bessemer Trust, has access to all records relating to Spears’ assets.
The petition to remove Britney Spears’ father, Jamie Spears, as conservator comes from social pressure. A documentary released last month highlighted the extent of the long conservatorship. “Whether or not there is an end to the conservatorship really depends on Britney. If she wants to end her conservatorship, she can file a petition to end it,” his lawyer said in an interview.
Spears has been under a state guardianship since the end of 2008 after her mental health deteriorated. Her father has been co-conservator or sole conservator during most of that period. At the start of 2019, she abruptly suspended her Las Vegas show because of her father’s health issues. In 2020, her lawyers began their attempts to get her father removed.
In November of last year, Britney’s lawyer said she was afraid of her father. She told the court that Spears no longer wanted her father involved in her care. She also stated that Spears refuses to perform as long as her father remains in charge of her conservatorship.
Now, this petition is just one slow step in removing Jamie Spears completely.
